1. General

1.1. Eligibility: You must be at least 18 years old to place an order. By placing an order, you represent and warrant that you have the legal capacity to enter into a binding contract with a-SORN.

1.2. Accuracy of Information: You agree to provide current, complete, and accurate purchase and account information. a-SORN reserves the right to refuse or cancel any order in the event that information provided is inaccurate or incomplete.

2. Accounts & Passwords

2.1. Account Creation: You may browse the Site without creating an account. However, to complete a purchase, you must create an a-SORN account or check out as a guest. You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.

2.2. Account Security: You agree to notify us immediately if you suspect any unauthorized use of your account. We will not be liable for any loss or damage resulting from your failure to comply with this section.

3. Products & Pricing

3.1. Product Descriptions: We attempt to be as accurate as possible in the description of our jewelry (materials, dimensions, care instructions). However, slight variations may occur. All weights, measurements, and dimensions are approximate.

3.2. Pricing: All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. We reserve the right to modify prices at any time before you submit your order. Price changes will not affect orders that have already been confirmed.

3.3. Promotions & Discounts: Promotional offers (sales, coupon codes) apply only to specified items and cannot be combined unless explicitly stated. We reserve the right to limit quantities and to discontinue or modify promotional offers at any time.

4. Ordering & Payment

4.1. Order Acceptance: Your receipt of an order confirmation email does not signify that your order has been accepted. We reserve the right to accept or decline your order for any reason, including unavailability of product, errors in pricing or product description, or suspected fraud.

4.2. Payment Methods: We accept major credit cards (Visa, MasterCard, American Express) and PayPal. Payment will be processed at the time the order is placed.

4.3. Taxes: Applicable sales taxes (GST/HST or PST, depending on the province) will be calculated and added to the total price during checkout.

5. Shipping & Delivery

5.1. Shipping Destinations: We currently ship within Canada only.

5.2. Processing Time: Orders typically take 5-7 business days to process. Vegetarian-leather or silver-plated items may require additional time; any delays will be communicated via email.

5.3. Standard Shipping:

Delivery within 5–7 business days (excluding pre-orders).
Orders over $80 CAD (after discounts) qualify for free shipping.
Once your order is dispatched, you will receive a confirmation email with tracking details.

5.4. Pre-Orders:

For items marked “Pre-Order,” the estimated delivery date is listed on the product page.
Pre-order orders will be processed in the order they were received.
You will be notified by email once your pre-order is ready to ship.

5.5. Shipping Restrictions & Delays:

We are not responsible for delays caused by the shipping carrier (e.g., weather, customs).
If an order is returned to us due to an incorrect address, you will be charged for reshipment.

6. Returns, Refunds, & Exchanges

6.1. Return Eligibility:

You may request a return or exchange within 5 days of receiving your order.
To be eligible, the item must be in brand-new condition, unworn, unstretched, unaltered, and in its original, full packaging (including swing tags and protective pouches).

6.2. Initiating a Return/Exchange:

Email us at jewelry@a-SORN.com with your order number, reason for return, and whether you want a refund or an exchange.
We will respond with return shipping instructions within 5 business days.

6.3. Return Shipping Costs:

You are responsible for paying shipping costs to return the item, unless the product arrived damaged, defective, or incorrect.
For damaged/defective items, we will provide a prepaid shipping label.

6.4. Refunds:

Once we receive and inspect the returned item, we will notify you of approval or rejection.
Approved refunds will be issued to your original payment method within 5–7 business days.
Shipping costs (unless the item was defective) are non-refundable.

6.5. Exchanges:

If you request an exchange, we will ship the replacement item after we receive and inspect the returned product. If the replacement item is more expensive, you will be charged the price difference; if it is less expensive, we will credit you the difference.

6.6. Final Sale Items:

Items marked “FINAL SALE” (e.g., clearance or closeout) are not eligible for return, refund, or exchange.

7. Intellectual Property

All content on www.a-sorn.com —including text, graphics, logos, images, videos, and software—is the property of a-SORN or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our express written permission.

8. Disclaimer of Warranties & Limitation of Liability

8.1. No Warranty:

All products are provided “as is.” a-SORN makes no warranties or representations about the accuracy or completeness of any information on this site.
To the fullest extent permitted by law, a-SORN disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8.2. Limitation of Liability:

In no event shall a-SORN be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use our products or Site.
a-SORN’s total liability for any claim arising out of or related to these Terms or the products is limited to the amount you paid for the product(s) in question.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada. Any dispute arising under or in connection with these Terms must be resolved exclusively in the courts of British Columbia, Canada. You agree to submit to the personal jurisdiction of those courts.

10. Severability

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms on the Site, with an updated “Last Updated” date. Your continued use of the Site after changes indicates your acceptance of the new Terms.
